Preamble
The website https://lepigalle.paris, hereinafter referred to as “the site,” is a hotel booking tool.
It is published by Biografy Group with a capital of €27,011,535, headquartered at 32 avenue de l’Opéra – 75002 PARIS, and registered with the Paris Trade and Companies Register under number RCS 429 706 781. For the application of these general terms and conditions of sale, it is agreed that the customers and LE PIGALLE will collectively be referred to as the “Parties” and individually as “Party,” and that the user who has validated a reservation or an order will then be referred to as the “customer.”
These general terms and conditions of sale apply to all countries and all currencies. Any reservation or order implies full acceptance of the general terms and conditions of sale.
LE PIGALLE reserves the right to modify these general terms and conditions of sale at any time by publishing a new version on the Site. The applicable general terms and conditions of sale are those in force on the date of the reservation or order placement.
ARTICLE 1: LEXICON
– “Confirmation Email”: An email sent by LE PIGALLE at the final step of the booking or ordering process. It summarizes the reservation validated by the customer and confirms its receipt by the site https://lepigalle.paris. The confirmation email constitutes a reservation confirmation as defined below.
– “Reservation Confirmation”: A dematerialized document that summarizes the characteristics of the services booked at the end of the booking process and its validation by the Customer. The reservation confirmation notably occurs after a booking made on the site https://lepigalle.paris during which the customer enters their credit card number for online payment or a guarantee before final validation.
– “Establishment Contract”: A contract for the provision by LE PIGALLE establishments of all the services defined below and actually ordered by the Customer following the validation of their online reservation or by another booking method.
– “Customer”: An adult individual with full legal capacity when subscribing to the establishment contract.
– “Reservation Request”: A request for booking rooms or restaurant tables made by the customer via mobile communication services or the internet.
– “Mobile Services”: A set of services and protocols allowing mobile phones to connect to the Internet and, in particular, enabling the consultation and booking of services provided by LE PIGALLE.
– “Online Booking”: Booking of hotel rooms, restaurant tables, and any additional accessories or services offered by LE PIGALLE establishments on its site https://lepigalle.paris.
– “Booking by Phone or Email”: Booking of rooms or additional services offered by LE PIGALLE by phone call or email sent by the Customer following the booking registration process described in these general terms and conditions of sale.
– “Establishment”: Refers to LE PIGALLE establishments offering rooms or any other ancillary services offered on the site https://lepigalle.paris.
– “Services”: Services marketed by LE PIGALLE consisting, as part of a contract with the establishment, of providing rooms whose essential characteristics are presented on the site https://lepigalle.paris with or without meal and/or breakfast services and other complementary services related to temporary accommodation, including artistic events. These services are listed on the website https://lepigalle.paris according to the provisions of Article L. 111-1 of the Consumer Code.
– “Extras”: Services marketed by LE PIGALLE consisting, as part of a contract between the establishment and the customers, of services different and complementary to those offered in the provision of rooms whose essential characteristics are presented on the website https://lepigalle.paris.
– “Website”: An electronic service operated by LE PIGALLE on the internet and accessible via the URL: https://lepigalle.paris.
– “WAP”: A communication protocol aimed at allowing access to the Internet using a mobile device.
ARTICLE 2: SCOPE OF APPLICATION
2.1 EXTENT
These general terms and conditions apply without restriction or reservation to all services offered on the website https://lepigalle.paris by LE PIGALLE operating the aforementioned site, particularly for the purpose of booking rooms and other complementary services for temporary accommodation in the establishment.
2.1.2. These General Terms and Conditions apply to all subscription operations for the services defined above carried out by the Customer.
2.2 TERRITORY
The services listed on this website are offered to be provided to the Customer by LE PIGALLE in one of its establishments, to the exclusion of any other location following an effective reservation by the Customer.
2.3 DURATION
2.3.1. These general terms and conditions apply throughout the duration of the online services by LE PIGALLE on its website https://lepigalle.paris.
2.3.2. LE PIGALLE reserves the right without notice or compensation to temporarily or permanently close the website https://lepigalle.paris or the online booking space.
2.3.3. LE PIGALLE is not responsible for any damages of any kind that may result from a temporary unavailability or even the permanent closure of all or part of the site or the services associated with it, such as the online booking space.
2.4 LEGAL FRAMEWORK
2.4.1. These general terms and conditions are subject to the provisions of Articles L. 121-16 and following of the Consumer Code.
2.4.2. Any reservation for the consumption of the services defined above made on the website https://lepigalle.paris is subject to these general terms and conditions and specific pricing terms for each of the said services LE PIGALLE listed below.
2.5 OBJECT
2.5.1. These general terms and conditions define the rights and obligations of the parties within the framework of the remote booking of services offered by LE PIGALLE on its website https://lepigalle.paris.
2.5.2. They govern all the steps necessary for the booking and follow-up of the reservation between the contracting parties for its maintenance and validity.
ARTICLE 3: CUSTOMER CAPACITY AND ACCEPTANCE
3.1 The customer has no legal right of withdrawal when purchasing a stay online. Indeed, Article L. 121-21-8 12° of the Consumer Code stipulates that the right of withdrawal cannot be exercised for contracts for the provision of accommodation services, among others.
If you wish to cancel your reservation, check the terms of your reservation.
3.2. Any Customer acknowledges having the capacity to contract under the conditions described in the general terms and conditions presented below, that is, being of legal age and not being under guardianship or curatorship. However, the Management of the establishment reserves the right to request the Customer, upon arrival at the establishment, to provide an identity document indicating their date of birth.
3.3. The Customer acknowledges that these terms and conditions are an integral part of the establishment contract.
3.4. The Customer agrees that the general terms and conditions, the contractual documents informing them of the services and specific rates for each of the services, as well as the order forms and the procedures for doing so, are presented to them online on the website https://lepigalle.paris for the purpose of concluding the establishment contract.
3.5. The Customer declares that they have obtained from LE PIGALLE all the necessary information on the website https://lepigalle.paris.
3.6. The Customer acknowledges having read these general terms and conditions, accepted them, and all the terms of the offer before placing their order and having accepted all the terms.
3.7. Any validation of an online reservation from the website https://lepigalle.paris by the Customer implies the prior consultation and acceptance of these general terms and conditions.
3.8. The Customer’s agreement to these general terms and conditions occurs during the booking process before the final validation of their reservation.
3.9. The Customer, prior to ordering the services, declares that the booking of these services is done for their personal needs.
3.10. The Customer has the option to save and print these general terms and conditions from the website https://lepigalle.paris using the standard functionalities of their browser and/or computer, especially under the “CGV” tab.
3.11. The Customer expressly agrees that entering the required banking information, accepting these general terms and conditions, and validating the order form or reservation request constitute an electronic signature within the meaning of Article 1316-4 of the Civil Code, which has the same value between the parties as a handwritten signature.
3.12. The Customer, upon presentation of their identity document as stated in Article 3.1 above, is required to fill out the individual police form in countries concerned by this article, in accordance with the provisions of Article R. 611-42 of the Code of Entry and Residence of Foreigners.
ARTICLE 4: SITE CONTENT
4.1. The site includes the following information:
– The identification of the company LE PIGALLE, indicating its corporate name, the address where it is established, its email address.
– The essential characteristics of the accommodations offered (the descriptions of each room category offered can be viewed outside of booking under the “ROOMS” section for each concerned establishment during the booking process under the room availability calendar and when selecting the room according to the dates chosen by the Customer for their reservation, possibly illustrated by a photographic image of a room at the same rate. It is specified that THE PHOTOS ARE NON-CONTRACTUAL as the elements of interior presentation or decoration as well as the sizes of the rooms differ within the same establishment or from one establishment to
another for the same category.
– The booking methods.
– The price details for each accommodation.
– The terms of payment.
– These general terms and conditions.
ARTICLE 5: ONLINE RESERVATION PROCESS
5.1. The reservations made by the Customer are carried out via the dematerialized reservation form available online on the site https://lepigalle.paris.
5.2. A reservation is deemed to have been made upon receipt by the Customer of the confirmation email sent by LE PIGALLE. Consequently, the data recorded by LE PIGALLE in its computer system constitutes proof of the booking and transaction made by the Customer.
5.3. When making a reservation, the Customer agrees to fill out the requested information on the reservation form in good faith. The Customer attests to the truthfulness and accuracy of the transmitted information.
5.4. The Customer can book rooms on the site https://lepigalle.paris as follows:
– The Customer selects the chosen establishment, the desired type of room, and the dates of stay.
– The Customer checks the details of their reservation, its total price, and corrects possible errors before confirming it to express their acceptance.
– The Customer enters their personal details.
– The Customer accepts the general terms and conditions of sale.
– The Customer confirms their reservation.
5.5. Once the reservation is confirmed, LE PIGALLE sends the Customer a confirmation email containing the essential details of the reservation, the services booked, the prices, and the conditions for canceling or modifying the reservation.
5.6. The Customer can modify or cancel their reservation under the conditions stipulated in these general terms and conditions of sale.
ARTICLE 6: PRICES AND PAYMENT TERMS
6.1. The prices related to the booking of services are indicated before and during the reservation process.
6.2. The prices are displayed in Euros and include all taxes. They are subject to change at any time by LE PIGALLE, without notice. Only the price indicated in the reservation confirmation is contractually binding.
6.3. The payment of all services is done by credit card through a secure online payment system. The accepted credit cards are indicated on the website.
6.4. The Customer’s credit card is charged the total amount of the reservation upon receipt of the confirmation email, except in the case of specific conditions or rates where the charge occurs according to different terms (e.g., special rates, prepaid rates, etc.).
6.5. LE PIGALLE reserves the right to cancel any reservation if the Customer’s bank card is declined.
ARTICLE 7: CANCELLATION OR MODIFICATION OF THE RESERVATION
7.1. For reservations with a flexible rate:
– The Customer can cancel or modify their reservation without charge up to 48 hours before the arrival date. Beyond this period, the first night will be charged as a cancellation fee.
7.2. For non-refundable, prepaid reservations:
– These reservations cannot be canceled or modified. The full amount of the stay is charged at the time of booking and is non-refundable.
7.3. In case of no-show (i.e., the Customer does not check-in on the scheduled arrival date without prior notice), the entire stay will be charged, and the reservation will be canceled.
7.4. Any request for modification or cancellation must be made through the site https://lepigalle.paris or by contacting the establishment directly.
ARTICLE 8: RESPONSIBILITY
8.1. LE PIGALLE’s responsibility cannot be engaged in case of non-performance or poor performance of the reservation due to the Customer, due to a third party, or in case of force majeure.
8.2. The photographs presented on the site are not contractual. Even if every effort is made to ensure that the photographs, graphic representations, and texts reproduced to illustrate the presented establishments give as accurate a preview as possible of the accommodation services offered, variations may occur, particularly due to the change of furniture or possible renovations.
8.3. LE PIGALLE cannot be held responsible for the non-execution or poor execution of the reservation in case of force majeure, due to a third party, or the Customer.
ARTICLE 9: PERSONAL DATA
9.1. The Customer is informed that the personal data collected in the context of their reservation is subject to automated data processing.
9.2. The Customer has the right to access, modify, rectify, and delete data concerning them by contacting: contact@biografygroup.com.
9.3. LE PIGALLE ensures the protection of personal data in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act.
ARTICLE 10: APPLICABLE LAW AND DISPUTES
10.1. These general terms and conditions of sale are governed by French law.
10.2. In case of dispute, an amicable solution will be sought before any legal action. In the absence of an amicable resolution, the dispute will be brought before the competent French courts.
ARTICLE 11: MISCELLANEOUS PROVISIONS
11.1. The Parties acknowledge that these general terms and conditions of sale constitute the entire agreement between them.
11.2. If one or more provisions of these general terms and conditions are declared null and void or unenforceable by a competent court, they will be declared unwritten and will not affect the validity of the other provisions.
11.3. The fact that one of the Parties does not demand the application of any clause of these general terms and conditions or acquiesces to its non-performance, whether permanently or temporarily, shall not be construed as a waiver by that Party of its rights under the said clause.
